LIABILITY WAIVER
In consideration of participation in the exercise training experience provided by Fire Cycle Fitness LLC and/or my use of the exercise equipment and facilities provided by Fire Cycle Fitness LLC, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that Fire Cycle Fitness LLC and its insurers, employees, officers, directors, and associates (collectively or individually, its “Personnel”), shall not be liable for any damages arising out of or from personal injuries (including death) sustained by me, or my guest in as a result of such participation in the exercise training experience and/or use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from any negligence of Fire Cycle Fitness LLC or any of its Personnel.

By executing this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, whether minor guest or adult and I hereby fully and forever release and discharge Fire Cycle Fitness LLC and its Personnel from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the participation in the exercise training experience and/or use of the equipment or facilities.

I expressly agree to indemnify and hold Fire Cycle Fitness LLC and its Personnel harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from or out of injuries or damages sustained by me or my guest.

I agree to be solely responsible for safety and well being of my guest and myself. I understand that Fire Cycle Fitness LLC does not provide supervision, instruction, or assistance for the use of the facilities and equipment.

I agree to comply with all rules imposed by Fire Cycle Fitness LLC and its Personnel (if applicable) regarding the participation in the exercise training experience and/or use of The equipment or facilities. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from participating in exercises or using any equipment, in each case, in a manner inconsistent with its intended design and purpose.

I understand and acknowledge that participation in exercises and the use of exercise equipment, in each case, involves risk of serious injury, including minor injuries, permanent disability and/or death.

I understand and agree that neither Fire Cycle Fitness LLC nor its Personnel are responsible for property that is lost, stolen, and/or damaged in, on, or about the premises, in each case, whether before, during or after participating in the exercise training experience.

I understand and agree that my use of the facilities and equipment is only to be undertaken on my own personal time, and that my participation in the exercise training experience and/or use of the facilities and equipment is not within the course or scope of my employment.

I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY; AND WITH FULL KNOWLEDGE OF ITS CONTENTS, I VOLUNTARILY GIVE MY FULL AGREEANCE TO THESE TERMS BY MY ACT OF CREATING AN ACCOUNT FOR UTILIZING ANY AND ALL SERVICES OF Fire Cycle Fitness LLC.
