LIABILITY WAIVER, ASSUMPTION OF RISK & MEDIA RELEASE

1. ACKNOWLEDGMENT AND AGREEMENT

In consideration of being permitted to participate in fitness classes, exercise programs, special events, and other activities offered by Fire Cycle Fitness LLC (“Fire Cycle Fitness”), or to use its facilities, equipment, and services, I acknowledge that I have read, understand, and voluntarily agree to the terms of this Liability Waiver, Assumption of Risk, and Media Release (“Agreement”).

This Agreement applies to all Fire Cycle Fitness activities, including those conducted at its studio, outdoors, at off-site events, or at other authorized locations.

I understand that participation in physical fitness activities involves inherent risks and voluntarily choose to participate.

2. ASSUMPTION OF RISK

I understand and acknowledge that participation in physical exercise, including but not limited to indoor cycling, infrared-heated cycling, strength training, sculpt classes, core conditioning, stretching, and other fitness activities, involves inherent risks.

These risks may include:

Muscle strains, sprains, and other physical injuries
Falls, slips, or loss of balance
Injuries associated with stationary bicycles, weights, or other exercise equipment
Overexertion, fatigue, dizziness, or fainting
Dehydration, overheating, or heat-related illness
Cardiovascular complications
Aggravation of preexisting medical conditions
Serious injury, permanent disability, or death

I acknowledge that infrared-heated environments may increase physical demands and the potential for dehydration, overheating, or other heat-related complications.

I voluntarily assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by applicable law.

3. HEALTH AND PHYSICAL CONDITION

I acknowledge that I am responsible for evaluating my physical condition and determining whether I am capable of safely participating in Fire Cycle Fitness activities.

I understand that Fire Cycle Fitness does not provide medical examinations, diagnoses, or medical treatment.

I agree to consult a qualified healthcare professional before participating if I have any medical condition, injury, physical limitation, or other health concern that may affect my ability to exercise safely.

I understand that I am responsible for monitoring my physical condition during classes and agree to stop exercising and notify an instructor if I experience pain, dizziness, difficulty breathing, unusual discomfort, or other concerning symptoms.

I acknowledge that instructors may offer exercise modifications but cannot guarantee that any activity is free from risk.

4. USE OF EQUIPMENT AND FACILITIES

I agree to use all exercise equipment, including stationary bicycles, weights, resistance equipment, and other fitness accessories, only for their intended purposes.

I agree to follow instructions provided by Fire Cycle Fitness instructors and personnel regarding equipment use, class participation, and facility safety.

I understand that improper use of equipment may result in injury.

I agree not to move, alter, or interfere with studio equipment in a manner inconsistent with instructor guidance or facility rules.

I acknowledge that Fire Cycle Fitness may restrict or discontinue my participation if my conduct presents a safety concern.

5. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by applicable Wisconsin law, I voluntarily release and discharge Fire Cycle Fitness LLC, its owners, members, managers, officers, directors, employees, instructors, contractors, agents, representatives, insurers, successors, and assigns (collectively, the “Released Parties”) from claims, demands, causes of action, damages, losses, or liabilities arising from my participation in Fire Cycle Fitness activities or use of its facilities and equipment.

This release includes claims involving ordinary negligence by the Released Parties to the extent such claims may lawfully be released.

I understand that this Agreement is intended to release the Released Parties from liability for covered injuries or losses, including serious bodily injury or death, but does not waive claims that cannot legally be waived.

I acknowledge that I am voluntarily agreeing to this release as a condition of participation.

6. INDEMNIFICATION

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from third-party claims, damages, liabilities, and reasonable expenses arising from my negligent, reckless, or intentional misconduct, violation of studio rules, or unauthorized use of equipment.

This provision does not require me to indemnify any Released Party for that party’s own negligence or misconduct where such indemnification is prohibited by law.

7. GUESTS AND MINORS

I understand that any guest accompanying me must comply with Fire Cycle Fitness policies and participation requirements.

Each adult participant is responsible for reviewing and accepting the applicable Liability Waiver before participating.

A parent or legal guardian must provide any required consent and execute appropriate agreements before a minor participates in Fire Cycle Fitness activities.

I acknowledge that I cannot independently waive the legal rights of another adult participant.

Any waiver or release involving a minor is subject to applicable law and must be completed by an authorized parent or legal guardian.

8. PERSONAL PROPERTY

I understand that Fire Cycle Fitness is not responsible for personal belongings that are lost, stolen, misplaced, or damaged while on its premises or during its activities, except to the extent liability cannot legally be excluded.

I am responsible for securing my personal belongings and exercising reasonable care while using the facilities.

9. STUDIO RULES AND PARTICIPANT CONDUCT

I agree to comply with all posted studio policies, instructor directions, equipment guidelines, and reasonable safety requirements.

I agree to conduct myself respectfully and responsibly while participating in Fire Cycle Fitness activities.

Fire Cycle Fitness reserves the right to deny, suspend, or terminate participation when reasonably necessary to protect the safety of participants, staff, or property, subject to applicable law.

10. PHOTOGRAPHY, VIDEO RECORDING & MEDIA RELEASE

I acknowledge and understand that Fire Cycle Fitness LLC may photograph, film, livestream, or otherwise record classes, events, activities, and experiences occurring within its studio, at off-site events, or during other Fire Cycle Fitness activities.

These recordings may include my image, likeness, voice, appearance, and participation in fitness activities.

Promotional and Public Use

Subject to the media consent and opt-out provisions below, I authorize Fire Cycle Fitness LLC to use photographs, video recordings, audio recordings, and other content featuring my image, likeness, or voice for legitimate business, marketing, advertising, promotional, educational, and public relations purposes.

Authorized uses may include, but are not limited to:

Instagram, Facebook, TikTok, YouTube, Snapchat, and other social media platforms
Fire Cycle Fitness websites and mobile applications
Digital advertisements and paid social media campaigns
Promotional videos, reels, stories, and other short-form content
Email marketing and electronic newsletters
Printed advertisements, brochures, and promotional materials
Public relations campaigns and media publications
Event recaps, studio announcements, and community engagement content
Other current or future promotional channels operated or authorized by Fire Cycle Fitness

I understand that promotional content may be published publicly and may be viewed, shared, downloaded, or redistributed by others.

Use of Image and Likeness

Where I have provided affirmative media consent, I grant Fire Cycle Fitness LLC a nonexclusive, worldwide, royalty-free license to reproduce, publish, display, distribute, and reasonably edit authorized photographs, recordings, and other media featuring my image, likeness, or voice for the purposes described above.

This authorization includes reasonable editing, cropping, formatting, and adaptation of content for different media platforms.

Fire Cycle Fitness will not knowingly use my image or likeness in a materially misleading, defamatory, or unlawful manner.

I understand that I will not receive compensation for authorized promotional uses unless otherwise agreed in writing.

Media Consent and Opt-Out

I understand that photography and video recording may occur during classes and events.

I may decline consent for promotional use of my image, likeness, or voice without losing access to ordinary Fire Cycle Fitness classes or services.

To request exclusion from promotional photography, video recordings, or other marketing content, I may submit a written request to:

My request should include:

My first and last name
The email address associated with my Fire Cycle Fitness account
My membership type or account status, if applicable
A statement requesting exclusion from promotional photography, video recordings, and marketing materials

Fire Cycle Fitness will make reasonable efforts to honor media opt-out requests and avoid intentionally featuring individuals who have declined promotional media consent.

I understand that incidental appearances may occur in group settings or background footage. Fire Cycle Fitness will review reasonable requests to remove or modify identifiable promotional content within its control.

Previously Published Content

I understand that withdrawing media consent generally applies to future use.

Previously published content may remain accessible through third-party platforms, reposts, archives, or materials outside Fire Cycle Fitness’s direct control.

Fire Cycle Fitness will make reasonable efforts to address removal requests involving identifiable content that it controls, subject to applicable law and any previously granted authorization.

Member-Created Content

I understand that other participants may independently create or share content.

Fire Cycle Fitness is not responsible for independently published content created by unrelated third parties, except as otherwise required by law.

Members and guests are expected to respect the privacy and preferences of other participants when photographing or recording within the studio.

Fire Cycle Fitness may establish or enforce restrictions on personal photography, filming, or livestreaming to protect participant privacy and safety.

11. EMERGENCY RESPONSE

In the event of an injury or medical emergency, I authorize Fire Cycle Fitness personnel to contact emergency services when reasonably necessary.

I understand that Fire Cycle Fitness personnel are not medical professionals and that emergency assistance may be provided by independent emergency responders.

I acknowledge that I may be financially responsible for emergency medical services, transportation, or treatment provided to me, subject to applicable law.

12. ELECTRONIC ACCEPTANCE AND ACCOUNT REGISTRATION

Fire Cycle Fitness LLC utilizes Mariana Tek, a third-party membership management and booking platform, to facilitate customer account registration, class reservations, and electronic agreement acceptance.

As part of the account registration process, customers are required to review and electronically sign the Fire Cycle Fitness Liability Waiver and Assumption of Risk before completing their account registration.

By electronically signing this Agreement through Mariana Tek, I acknowledge that I have been provided the opportunity to review its contents, understand its terms, and voluntarily agree to be bound by its provisions.

My electronic signature constitutes my acknowledgment and acceptance of this Agreement to the extent permitted by applicable law.

I further acknowledge that the Fire Cycle Fitness Privacy Policy is a separate document governing the collection, use, and protection of personal information.

Fire Cycle Fitness may maintain electronic records of signed agreements, including the date of acceptance and applicable agreement version, through its authorized membership management platform.

13. GOVERNING LAW AND SEVERABILITY

This Agreement shall be governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be addressed in accordance with applicable law, and the remaining provisions shall continue in effect to the extent legally permissible.

Nothing in this Agreement is intended to waive rights or remedies that cannot lawfully be waived.

14. ACKNOWLEDGMENT OF UNDERSTANDING AND VOLUNTARY ACCEPTANCE

PLEASE READ CAREFULLY BEFORE ACCEPTING.

I acknowledge and agree that:

I have read and understand this Liability Waiver, Assumption of Risk, and Media Release.
I understand that physical exercise and participation in fitness activities involve risks of injury, illness, permanent disability, and death.
I voluntarily assume the risks associated with participation.
I understand that this Agreement contains a release of liability, including certain claims involving ordinary negligence, to the extent permitted by Wisconsin law.
I agree to comply with Fire Cycle Fitness rules, safety instructions, and participation requirements.
I understand that photography and video recording may occur and that promotional media use is governed by the consent provisions described above.
I understand that I may decline or withdraw promotional media consent as described in this Agreement.
I understand that my electronic signature or affirmative acceptance constitutes my agreement to the applicable terms.

BY ELECTRONICALLY SIGNING OR AFFIRMATIVELY ACCEPTING THIS AGREEMENT, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO ITS TERMS.
